Terms of Service

The short version: Use JobHub fairly and legally, pay your subscription on time, and don't do anything that would harm other users or the platform. If something goes wrong, our liability is limited to what you've paid us in the last 12 months.

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the JobHub website at jobhubco.com and the JobHub application at jobhubco.com (together, the "Service"), operated by JobHub Co. ("JobHub," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Eligibility

You must be at least 18 years old to use the Service. By using JobHub, you represent and warrant that you meet this requirement and that your use of the Service complies with all applicable laws and regulations.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

4. Subscription and billing

Subscription plans. Access to JobHub requires a paid subscription. Current pricing is displayed at jobhubco.com.

Founding member pricing. Customers who subscribe during the founding member period receive the following pricing commitment, provided their subscription remains active and in good standing:

This pricing commitment applies only while your subscription remains continuously active. If you cancel and later resubscribe, founding member pricing will no longer apply.

Billing. Subscriptions are billed monthly or annually in advance. Payments are processed securely by Stripe. By providing payment information, you authorize us to charge your payment method on a recurring basis.

Free trial. We may offer a 14-day free trial for new accounts. No charge is made during the trial period. Your subscription begins and your payment method is charged at the end of the trial unless you cancel before the trial expires.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial billing periods.

Price changes. We may change standard subscription prices at any time with at least 30 days' written notice. For founding members, price changes to the standard rate will automatically update your rate to reflect the 15% founding member discount after your 3-year lock-in period has elapsed, as described above.

Taxes. Prices do not include applicable taxes. You are responsible for any taxes applicable to your subscription.

You agree to use JobHub only for lawful purposes and in accordance with these Terms. You agree not to:

Ownership. You retain ownership of all data, content, and information you input into JobHub ("Your Data"). We claim no ownership over Your Data.

License to us. By using the Service, you grant JobHub a limited, non-exclusive license to store, process, and display Your Data solely as necessary to provide the Service to you.

Data accuracy. You are solely responsible for the accuracy, quality, and legality of Your Data and for ensuring you have the necessary rights to submit it to the Service.

Data export. You may export your data from JobHub at any time while your subscription is active. Upon cancellation, you have 30 days to export your data before it is deleted.

7. Third-party integrations

JobHub integrates with third-party services including QuickBooks Online, Stripe, and payroll providers (ADP, Gusto, Paychex, QuickBooks Payroll). Your use of these integrations is subject to the respective terms of service of those providers. JobHub is not responsible for the actions, content, or policies of third-party services.

Connecting a third-party integration constitutes your authorization for JobHub to access and exchange data with that service on your behalf for the purpose of providing the integration features.

8. Intellectual property

The Service and its original content, features, and functionality are and will remain the exclusive property of JobHub Co. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of JobHub.

Nothing in these Terms grants you any right to use the JobHub name, logo, or other brand elements.

9. Confidentiality

Each party agrees to keep confidential any non-public information of the other party that is designated as confidential or that reasonably should be understood to be confidential. This obligation does not apply to information that is publicly known, independently developed, or required to be disclosed by law.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. JOBHUB DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

JobHub is a business management tool. We do not provide legal, tax, financial, or accounting advice. You should consult qualified professionals for such advice.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JOBHUB'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO JOBHUB IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

IN NO EVENT SHALL JOBHUB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless JobHub and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, Your Data, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately, if we believe you have violated these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

You may terminate these Terms at any time by canceling your subscription and stopping use of the Service.

Sections 6 (Your Data), 8 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), and 12 (Indemnification) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of South Dakota, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in Meade County, South Dakota, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on our website at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the updated Terms.
